SafeHaven Counselling respects your privacy and is committed to protecting your personal data.

This notice is prepared with reference to the Personal Data Protection Act 2010 and explains how SafeHaven Counselling collects, uses, stores, discloses, and protects personal data in connection with its website, enquiries, bookings, counselling-related administration, and counselling services.

1. Personal Data Collected

SafeHaven Counselling may collect personal data such as:

Some personal data collected in the counselling context may include sensitive personal data, including information related to health, mental health, emotional wellbeing, family background, relationships, or other personal circumstances shared for counselling purposes.

Where a client is below 18 years old, personal data relating to the client and the client’s parent or guardian may also be collected.

2. Sources of Personal Data

SafeHaven Counselling may collect personal data from: website enquiry forms; email, WhatsApp, phone, or other communication with SafeHaven Counselling; booking and practice management platforms; registration, intake, informed consent, or other counselling-related forms; payment or appointment records; online counselling or telehealth platforms; cookies, analytics tools, advertising tools, or similar website technologies, where used; and referrals or third parties, where the client has provided consent or where this is permitted or required by law.

3. Purposes of Collecting and Processing Personal Data

Personal data may be collected and processed to: respond to enquiries; manage appointments, bookings, payments, reminders, and administrative communication; provide access to relevant forms and counselling-related information; provide counselling services; maintain counselling-related records; communicate about appointments or service-related matters; support online counselling and telehealth sessions; comply with legal, ethical, regulatory, professional, insurance, or administrative requirements; protect the safety of the client or another person, where required or permitted by law, ethics, or safety concerns; improve SafeHaven Counselling’s website, services, communication, and client experience; and understand website use and advertisement performance, where analytics or advertising tools are used.

SafeHaven Counselling does not sell personal data. Counselling-related records and sensitive personal data are not used for advertising or marketing purposes.

4. Use of Cookies and Website Tools

The SafeHaven Counselling website may use cookies, analytics tools, advertising tools, or similar technologies to understand how visitors use the website and how website content or advertisements perform. These tools may collect information such as pages visited, general location, device or browser information, and interactions with the website. Visitors may adjust browser settings to refuse or manage cookies. However, some website functions may not work as intended if cookies are disabled.

5. Third-Party Platforms and Disclosure of Personal Data

SafeHaven Counselling may use third-party platforms or service providers to support website operation, booking, payment, appointment administration, form collection, telehealth, communication, analytics, or advertising, including platforms used for website hosting, booking and practice management, online counselling or telehealth, form collection, payment processing, email and administrative communication, WhatsApp Business communication, and analytics or advertising, where applicable.

SafeHaven Counselling may disclose personal data only where necessary and appropriate, including to: third-party service providers supporting SafeHaven Counselling’s operations; professional consultants, where consultation is needed to support ethical and professional care; other professionals or services, with the client’s written consent; legal, regulatory, enforcement, or government authorities, where required or permitted by law; and relevant parties where there is a serious safety concern and disclosure is required or permitted by law, ethics, or safety concerns.

Where third-party platforms are used, those platforms may have their own privacy practices, security measures, and terms.

6. Processing and Storage of Personal Data

Personal data may be processed and stored through physical records, digital records, email systems, website systems, booking systems, payment systems, telehealth systems, and secure third-party platforms, including SafeTalk where applicable. Some third-party service providers may process or store data in Malaysia or outside Malaysia. Where this applies, SafeHaven Counselling will take reasonable steps to ensure that personal data is handled securely.

7. Security Measures

SafeHaven Counselling takes reasonable steps to protect personal data from unauthorised access, misuse, loss, disclosure, alteration, or destruction. These steps may include the use of secure platforms, password protection, access controls, professional record-keeping practices, and limiting access to personal data where appropriate. However, no website, online system, email, messaging platform, or internet transmission can be guaranteed to be completely secure.

8. Retention of Personal Data

SafeHaven Counselling will retain personal data for as long as necessary for counselling, administrative, legal, ethical, professional, insurance, or record-keeping purposes. Counselling-related records may generally be retained for up to seven (7) years after the counselling relationship ends, unless a longer retention period is required or appropriate for legal, professional, insurance, dispute-related, or safety reasons. When personal data is no longer required, SafeHaven Counselling will take reasonable steps to securely delete, destroy, anonymise, or archive the data, where appropriate.

9. Providing Personal Data

Some personal data is required for SafeHaven Counselling to respond to enquiries, manage bookings, provide counselling services, process payments, maintain records, and meet legal or professional obligations. If required personal data is not provided, SafeHaven Counselling may not be able to respond to an enquiry, confirm an appointment, provide counselling services, or complete related administrative processes. Some information may be optional. Where information is optional, clients may choose whether to provide it.

10. Rights Relating to Personal Data

You may request to: access your personal data held by SafeHaven Counselling; correct or update your personal data; ask questions about how your personal data is processed; withdraw consent or limit the processing of your personal data, where applicable; and stop receiving promotional or marketing communication, where applicable.

Please note that withdrawing consent or limiting the processing of personal data may affect SafeHaven Counselling’s ability to provide counselling services, manage appointments, maintain records, or comply with legal, ethical, professional, or administrative requirements.

11. Counselling Records and Informed Consent

Counselling-related records and sensitive personal data are handled with confidentiality and care. Further information about confidentiality, limits to confidentiality, counselling records, online counselling, SafeTalk, communication boundaries, and counselling-related procedures is provided in SafeHaven Counselling’s Professional Counselling Informed Consent Form, which is completed before counselling services begin.

12. Updates to This Notice

SafeHaven Counselling may update this Privacy Policy / Personal Data Protection Notice from time to time. The latest version will be made available on the SafeHaven Counselling website. The effective date and last reviewed date will be updated where appropriate.

Notis ini disediakan dengan merujuk kepada Akta Perlindungan Data Peribadi 2010 dan menerangkan bagaimana SafeHaven Counselling mengumpul, menggunakan, menyimpan, menzahirkan, dan melindungi data peribadi berkaitan laman web, pertanyaan, tempahan, pentadbiran berkaitan kaunseling, dan perkhidmatan kaunseling.

1. Data Peribadi yang Dikumpul

Sesetengah data peribadi yang dikumpul dalam konteks kaunseling mungkin termasuk data peribadi sensitif, termasuk maklumat berkaitan kesihatan, kesihatan mental, kesejahteraan emosi, latar belakang keluarga, hubungan, atau keadaan peribadi lain yang dikongsikan untuk tujuan kaunseling.

Jika klien berumur di bawah 18 tahun, data peribadi berkaitan klien dan ibu bapa atau penjaga klien juga mungkin dikumpul.

2. Sumber Data Peribadi

3. Tujuan Pengumpulan dan Pemprosesan Data Peribadi

Data peribadi mungkin dikumpul dan diproses untuk menjawab pertanyaan; mengurus janji temu, tempahan, pembayaran, peringatan, dan komunikasi pentadbiran; menyediakan akses kepada borang dan maklumat berkaitan kaunseling; menyediakan perkhidmatan kaunseling; menyimpan rekod berkaitan kaunseling; berkomunikasi mengenai janji temu atau perkara berkaitan perkhidmatan; menyokong sesi kaunseling dalam talian dan telehealth; mematuhi keperluan undang-undang, etika, kawal selia, profesional, insurans, atau pentadbiran; melindungi keselamatan klien atau orang lain, apabila diwajibkan atau dibenarkan oleh undang-undang, etika, atau kebimbangan keselamatan; menambah baik laman web, perkhidmatan, komunikasi, dan pengalaman klien SafeHaven Counselling; dan memahami penggunaan laman web dan prestasi iklan, jika alat analitik atau pengiklanan digunakan.

SafeHaven Counselling tidak menjual data peribadi. Rekod berkaitan kaunseling dan data peribadi sensitif tidak digunakan untuk tujuan pengiklanan atau pemasaran.

4. Penggunaan Cookies dan Alat Laman Web

Laman web SafeHaven Counselling mungkin menggunakan cookies, alat analitik, alat pengiklanan, atau teknologi yang serupa untuk memahami bagaimana pelawat menggunakan laman web dan bagaimana kandungan laman web atau iklan berfungsi. SafeHaven Counselling hanya akan menzahirkan data peribadi apabila perlu dan sesuai, termasuk kepada penyedia perkhidmatan pihak ketiga yang menyokong operasi SafeHaven Counselling; perunding profesional, apabila konsultasi diperlukan untuk menyokong penjagaan yang beretika dan profesional; profesional atau perkhidmatan lain, dengan persetujuan bertulis klien; pihak berkuasa undang-undang, kawal selia, penguatkuasaan, atau kerajaan, apabila diwajibkan atau dibenarkan oleh undang-undang; dan pihak berkaitan apabila terdapat kebimbangan keselamatan yang serius dan penzahiran diwajibkan atau dibenarkan oleh undang-undang, etika, atau kebimbangan keselamatan.

Apabila platform pihak ketiga digunakan, platform tersebut mungkin mempunyai amalan privasi, langkah keselamatan, dan terma mereka sendiri.

6. Pemprosesan dan Penyimpanan Data Peribadi

Data peribadi mungkin diproses dan disimpan melalui rekod fizikal, rekod digital, sistem e-mel, sistem laman web, sistem tempahan, sistem pembayaran, sistem telehealth, dan platform pihak ketiga yang selamat, termasuk SafeTalk jika berkaitan. Sesetengah penyedia perkhidmatan pihak ketiga mungkin memproses atau menyimpan data di Malaysia atau di luar Malaysia. Jika perkara ini berlaku, SafeHaven Counselling akan mengambil langkah yang munasabah untuk memastikan data peribadi dikendalikan dengan selamat.

7. Langkah Keselamatan

SafeHaven Counselling mengambil langkah yang munasabah untuk melindungi data peribadi daripada akses tanpa kebenaran, penyalahgunaan, kehilangan, penzahiran, perubahan, atau pemusnahan. Langkah ini mungkin termasuk penggunaan platform yang selamat, perlindungan kata laluan, kawalan akses, amalan penyimpanan rekod profesional, dan mengehadkan akses kepada data peribadi apabila sesuai. Walau bagaimanapun, tiada laman web, sistem dalam talian, e-mel, platform pemesejan, atau penghantaran melalui internet yang boleh dijamin selamat sepenuhnya.

8. Tempoh Penyimpanan Data Peribadi

SafeHaven Counselling akan menyimpan data peribadi selama mana yang diperlukan untuk tujuan kaunseling, pentadbiran, undang-undang, etika, profesional, insurans, atau penyimpanan rekod. Rekod berkaitan kaunseling secara umumnya mungkin disimpan sehingga tujuh (7) tahun selepas hubungan kaunseling berakhir, kecuali tempoh penyimpanan yang lebih lama diperlukan atau sesuai atas sebab undang-undang, profesional, insurans, pertikaian, atau keselamatan. Apabila data peribadi tidak lagi diperlukan, SafeHaven Counselling akan mengambil langkah yang munasabah untuk memadam, memusnahkan, menyahnamakan, atau mengarkibkan data tersebut dengan selamat, jika sesuai.

9. Pemberian Data Peribadi

Sesetengah data peribadi diperlukan untuk SafeHaven Counselling menjawab pertanyaan, mengurus tempahan, menyediakan perkhidmatan kaunseling, memproses pembayaran, menyimpan rekod, dan memenuhi keperluan undang-undang atau profesional. Jika data peribadi yang diperlukan tidak diberikan, SafeHaven Counselling mungkin tidak dapat menjawab pertanyaan, mengesahkan janji temu, menyediakan perkhidmatan kaunseling, atau melengkapkan proses pentadbiran yang berkaitan. Sesetengah maklumat mungkin bersifat pilihan. Jika maklumat tersebut bersifat pilihan, klien boleh memilih sama ada untuk memberikannya atau tidak.

10. Hak Berkaitan Data Peribadi

Anda boleh membuat permohonan untuk mengakses data peribadi anda yang disimpan oleh SafeHaven Counselling; membetulkan atau mengemas kini data peribadi anda; bertanya soalan tentang bagaimana data peribadi anda diproses; menarik balik persetujuan atau mengehadkan pemprosesan data peribadi anda, jika berkaitan; dan berhenti menerima komunikasi promosi atau pemasaran, jika berkaitan.

Sila ambil perhatian bahawa penarikan balik persetujuan atau pengehadkan pemprosesan data peribadi mungkin menjejaskan keupayaan SafeHaven Counselling untuk menyediakan perkhidmatan kaunseling, mengurus janji temu, menyimpan rekod, atau mematuhi keperluan undang-undang, etika, profesional, atau pentadbiran.

11. Rekod Kaunseling dan Persetujuan Termaklum

Rekod berkaitan kaunseling dan data peribadi sensitif dikendalikan dengan kerahsiaan dan penuh berhati-hati. Maklumat lanjut mengenai kerahsiaan, had kerahsiaan, rekod kaunseling, kaunseling dalam talian, SafeTalk, sempadan komunikasi, dan prosedur berkaitan kaunseling dinyatakan dalam Borang Persetujuan Termaklum Kaunseling Profesional SafeHaven Counselling, yang perlu dilengkapkan sebelum perkhidmatan kaunseling bermula.

12. Kemas Kini Notis Ini

SafeHaven Counselling mungkin mengemas kini Dasar Privasi / Notis Perlindungan Data Peribadi ini dari semasa ke semasa. Versi terkini akan disediakan di laman web SafeHaven Counselling. Tarikh berkuat kuasa dan tarikh terakhir disemak akan dikemas kini jika sesuai.
